PRIVACY POLICY

1. Introduction and Scope
This Privacy Policy describes how Himmelman Family, LLC d/b/a Mativa (“Company,” “we,” “us,” or “our”) collects, uses, discloses, retains, and otherwise processes Personal Information in connection with our website located at Mativa.co, including the online directory of independent therapists and practices (the “Directory”) and all related features, content, communications, and functionality made available through the website (collectively, the “Site”).
For purposes of this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual, household, or device, as defined by applicable law. Personal Information may include online identifiers such as IP addresses, cookie identifiers, and device identifiers even when a visitor does not submit a name or contact information.
Please read this Privacy Policy carefully. By accessing or using the Site, you acknowledge that you have read and understand this Privacy Policy.
This Privacy Policy does not apply to the privacy or information-handling practices of independent third parties, including Therapists listed in the Directory and any third-party websites, platforms, or services linked to or accessible through the Site.
Capitalized terms not defined in this Privacy Policy have the meanings assigned in our Terms of Service.
2. Important Information About the Directory
2.1 Consumers Are Not Required to Submit Personal or Detailed Clinical Information
Consumers may browse and search the Directory without creating an account or providing Company with their name, contact information, payment information, medical records, treatment history, or other detailed clinical information. To use certain search functionality, however, Consumers may select specialties, conditions, service needs, locations, or other health-related criteria to identify potentially relevant Therapists. These selections and related Site activity may constitute Consumer Health Data and are processed as described in this Privacy Policy and Company’s Consumer Health Data Privacy Policy.
The Site does not currently facilitate direct appointment booking, patient intake, clinical communications, or payment for therapy services. Consumers should not submit medical records, treatment details, crisis information, protected health information, or other confidential clinical information to Company.
2.2 Company Is a Directory Provider, Not a Healthcare Provider
Company is not a healthcare provider, mental health professional, therapy practice, referral agency, professional licensing authority, credentialing organization, or affiliate of any therapist. Company does not provide medical, psychological, behavioral health, counseling, therapy, diagnostic, treatment, crisis, or other professional services. Listings are submitted by or on behalf of independent Listing Providers and are displayed for advertising and informational purposes only.
2.3 Information Provided to Therapists and Third Parties
Information that a Consumer provides directly to a therapist, therapist practice, scheduling provider, website operator, or other third party is not collected by Company unless Company expressly states otherwise at the point of collection. That information is governed by the recipient’s own privacy notice, terms, professional obligations, and applicable law. Company is not responsible for the privacy or security practices of therapists or other third parties.
2.4 HIPAA
Company does not act as a healthcare provider, health plan, healthcare clearinghouse, or business associate in connection with the Site, the Directory, or any related features or functionality. The Site is not designed to receive, maintain, or transmit protected health information on behalf of a therapist or other HIPAA covered entity.
3. Information We Collect
The categories of information we collect depend on how you interact with the Site.
3.1 Information Collected From Consumers and General Visitors
Device and Network Information. IP address; browser type and version; device type; operating system; language and regional settings; internet service provider or mobile carrier; device and advertising identifiers; and similar technical information.
Usage and Interaction Information. Pages and Site features accessed; search terms; specialties, conditions, service needs, filters, and categories selected; locations searched; Listings viewed or selected; links or contact methods clicked; referring and exit pages; dates and times of access; session duration; navigation paths; cookie and browser identifiers; performance and diagnostic information; and similar information regarding use of the Site.
Location Information. Approximate location derived from an IP address and any city, ZIP code, state, or other location a user enters or selects when searching for Therapists. Company does not collect precise geolocation information through the Site.
Cookie and Advertising Information. Cookie identifiers, pixel and tag data, conversion events, campaign information, and information collected through analytics, advertising, and similar technologies as described in Section 8.
Communications. Information a person voluntarily provides when contacting Company, such as a name, email address, message content, feedback, privacy request, complaint, or customer-support inquiry. Consumers should not include medical, treatment, or crisis information in communications to Company.
3.2 Additional Information Collected From Listing Providers
Account and Business Contact Information. Name, business or practice name, business email address, telephone number, mailing or billing address, username, password or authentication credentials, account preferences, and information regarding authority to act for a practice or Listing Provider.
Listing Content. Photographs, biographies, practice descriptions, professional credentials, licenses, specialties, populations served, office locations, telehealth availability, contact details, website and social media links, fees, insurance information, availability, and other content submitted for public display in a Listing.
Professional and Practice Information. Information regarding professional status, business organization, practice locations, services, and other information supplied in connection with a Listing or a complaint. Company may request supporting information but does not represent that it independently verifies or credentials Listing Providers.
Billing and Transaction Information. Billing contact information, plan and subscription details, transaction history, invoices, payment status, chargebacks, and limited payment information received from payment processors. Complete payment-card details are generally processed directly by payment processors and are not stored by Company.
Account and Support Communications. Emails, support requests, renewal and cancellation communications, complaints, feedback, and other interactions with Company.
Security and Account Activity. Login dates and times, IP addresses, authentication events, account changes, and other information used to administer and secure Listing Provider accounts.
3.3 Information Received From Other Sources
Service Providers. Information from payment processors, cloud hosting providers, security vendors, analytics providers, advertising partners, communications vendors, customer-support tools, and other service providers that support the Site.
Public and Professional Sources. Where appropriate, information from public websites, professional or licensing sources, or other publicly available records, including in connection with responding to complaints or protecting the Site. Company’s receipt or review of such information does not constitute credentialing, verification, approval, or endorsement.
Advertising and Analytics Partners. Information collected or received through analytics, social media, advertising, and similar partners regarding referrals, interactions with the Site or advertisements, campaign attribution, and audience or conversion measurement, where permitted by applicable law.
4. How We Collect Information
Directly From You. When a Listing Provider creates or manages an account, submits Listing Content, purchases or manages a paid Listing, communicates with Company, or exercises privacy rights; or when any person voluntarily contacts Company.
Automatically Through the Site. Through cookies, pixels, tags, local storage, log files, APIs, device identifiers, and similar technologies when a person accesses or uses the Site.
From Service Providers and Third Parties. From payment processors, analytics and advertising partners, hosting and security vendors, authorized representatives, and other sources described above.
We may combine information collected from these sources to provide, operate, secure, improve, and personalize the Site, consistent with this Privacy Policy and applicable law.
5. How We Use Your Information
We may use Personal Information for the following business and commercial purposes:
Provide and Operate the Site. Display Listings; process searches and filters; enable users to locate therapist contact information; administer Listing Provider accounts; provide paid Listing functionality; and maintain the functionality of the Site.
Process Payments and Subscriptions. Process Listing Fees; administer subscriptions, renewals, cancellations, refunds, invoices, and taxes; detect payment fraud; and maintain transaction records.
Communicate and Provide Support. Respond to inquiries and complaints; provide technical support; send account, billing, renewal, security, legal, and service-related communications; and obtain or respond to feedback.
Personalize and Improve the Site. Remember settings; understand how the Site is used; evaluate search and Directory functionality; troubleshoot issues; test features; conduct analytics; and improve usability, performance, content, and design.
Security, Integrity, and Fraud Prevention. Authenticate accounts; protect the security and availability of the Site; detect, investigate, prevent, and respond to fraud, abuse, unauthorized access, malicious activity, policy violations, and security incidents.
Marketing and Advertising. Promote Company and the Site; measure campaign effectiveness; conduct conversion measurement; create audiences; and, subject to applicable law and the restrictions in Sections 8 and 9, support interest-based advertising and retargeting.
Legal and Compliance. Comply with law, legal process, tax and accounting requirements, and contractual obligations; enforce our agreements; protect Company, users, therapists, and others; and establish, exercise, or defend legal claims.
Corporate Transactions. Evaluate or complete an actual or proposed merger, acquisition, financing, investment, reorganization, sale of assets, bankruptcy, or similar transaction.
Other Disclosed Purposes. Carry out another purpose disclosed at the time information is collected or with your consent or direction.
Company may create and use aggregated or de-identified information that does not reasonably identify an individual, household, or device for analytics, benchmarking, security, product development, business planning, and other lawful purposes. We will not attempt to reidentify information that we maintain as de-identified except as permitted by applicable law to test our de-identification processes.
6. How We Disclose Information
We disclose Personal Information only as described in this Privacy Policy, with your authorization, or as otherwise permitted or required by applicable law.
We do not sell your Personal Information for monetary consideration.
We may disclose Personal Information to the following categories of recipients:
The Public. Listing Content is submitted for public display. Public Listings may be viewed, copied, indexed, cached, or republished by search engines, archival services, social media platforms, and other third parties. Removal from the Directory may not remove copies maintained by third parties.
Service Providers and Processors. Cloud hosting, data storage, payment processing, cybersecurity, customer support, communications, software development, infrastructure, analytics, auditing, and other vendors that process information on Company’s behalf.
Analytics and Advertising Partners. Analytics providers, advertising networks, social media platforms, and marketing partners that help measure usage and campaigns, attribute conversions, create audiences, or support advertising and retargeting, subject to applicable privacy choices and the health-related data restrictions described below.
Listing Providers and Third Parties at Your Direction. When a user chooses to click a Listing link, call a displayed telephone number, visit a therapist’s website, or otherwise interact with a third party. In many cases the information is transmitted directly to the third party rather than through Company.
Professional Advisors. Attorneys, accountants, auditors, insurers, lenders, consultants, and other professional advisors.
Government Authorities and Legal Recipients. Courts, regulators, law-enforcement agencies, governmental authorities, licensing boards, rights holders, or other parties when disclosure is required or permitted by law or reasonably necessary to protect rights, safety, security, or the Site.
Corporate Transaction Participants. Actual or prospective purchasers, investors, lenders, financing sources, merger partners, acquirers, successors, assignees, or other participants in an actual or proposed corporate transaction, subject to appropriate safeguards where required.
At Your Direction. Other parties with your consent, at your direction, or as otherwise disclosed when information is collected.
7. Public Listing Information
Information submitted for inclusion in a Listing is intended to be publicly available and may be displayed through the Site, Directory search results, sponsored or featured placements, Company marketing materials, social media, and other promotional or distribution channels. Listing Providers should submit only information that they are authorized and prepared to make publicly available.
8. Cookies and Similar Technologies
Company and its service providers and partners may use cookies, pixels, tags, web beacons, scripts, APIs, local storage, and similar technologies (collectively, “Cookies”) to operate, maintain, secure, analyze, improve, personalize the Site; remember preferences; authenticate users; prevent fraud; understand user engagement; and, where permitted by applicable law, support analytics, marketing, audience measurement, and advertising activities. Cookies may be placed by Company or by our service providers, analytics providers, advertising partners, or by other authorized third parties in connection with the operation of the Site.
8.1 Types of Cookies
Depending on your use of the Site, we may use the following categories of Cookies:
Strictly Necessary Cookies. Support core functionality, security, network management, account authentication, payment processing, and privacy choices. These Cookies cannot generally be disabled because the Site would not function properly without them.
Functional Cookies. Remember settings, preferences, language selections, and other choices to improve your experience and personalize certain Site features.
Analytics and Performance Cookies. Measure traffic and engagement, understand search and navigation patterns, identify errors, and improve performance and functionality.
Advertising Cookies. Measure campaigns and conversions, create or match audiences, limit repeated advertising, and support interest-based advertising or retargeting, where permitted by law.
8.2 How We Use Cookies
Company and its service providers may use Cookies to provide, operate, maintain, secure, and improve the Site; authenticate users and maintain secure sessions, where applicable; remember user preferences; analyze Site usage; measure performance; troubleshoot technical issues; detect and prevent fraud, abuse, and unauthorized access; improve the functionality and user experience of the Site; measure the effectiveness of our communications and marketing efforts; and, where permitted by applicable law, support analytics, audience measurement, remarketing, and other interest-based advertising activities.
Company and its service providers may also use pixels, web beacons, tags, and similar technologies on the Site and in emails or other electronic communications to determine whether communications have been opened, links have been clicked, Site features have been used, or users have otherwise interacted with the Site or Company’s communications.
8.3 Your Cookie Choices
Where required by applicable law, Company provides a Cookie Preference Center that allows you to accept, reject, or customize your preferences for non-essential Cookies. You may update your Cookie preferences at any time through the Cookie Preference Center or other settings made available through the Site.
You may also manage certain Cookies by changing your browser settings to block or delete Cookies or disable certain tracking technologies. You may also choose to use privacy-focused browsers or browser extensions that restrict certain tracking technologies. Please note that disabling certain Cookies or similar technologies may affect the availability, functionality, performance, or user experience of portions of the Site.
Certain web browsers permit users to transmit browser-based privacy preference signals, including Global Privacy Control (“GPC”). Where required by applicable law, Company recognizes and processes GPC signals as requests to opt out of the sale or sharing of Personal Information or targeted advertising for the browser or device from which the signal is transmitted.
Except as described above or otherwise required by applicable law, the Site does not currently respond to browser “Do Not Track” (“DNT”) signals.
9. Marketing Communications
9.1 Transactional Communications
Company may communicate with Listing Providers and other Users regarding their accounts, Listings, subscriptions, transactions, inquiries, and requested services. These communications may include emails or other electronic notices relating to account creation and authentication, password resets, security alerts, billing, subscription renewals, Listing administration, customer support, Site updates, and changes to Company’s agreements or policies.
Because these communications are necessary to administer an active account, Listing, subscription, or requested service, Listing Providers generally may not opt out of receiving them while maintaining the applicable account, Listing, or subscription. Company will obtain any consent and provide any opt-out mechanism required by applicable law for communications sent by text message or other regulated channels.
9.2 Marketing Communications and Advertising.
Subject to applicable law and your privacy choices, Company may use Personal Information to communicate with you regarding the Site and our products and services, personalize marketing communications, measure the effectiveness of our marketing efforts, and improve our products, services, and marketing activities.
We, and our service providers and advertising partners, may also use cookies, pixels, web beacons, and similar technologies to understand how users interact with the Site, our communications, and other online services and, where permitted by applicable law, to support interest-based advertising, audience measurement, remarketing, and similar advertising activities.
Where required by applicable law, Company will obtain your consent before using non-essential cookies or similar technologies for advertising purposes and will honor applicable opt-out rights, including browser-based privacy preference signals such as GPC. Company does not use identifiable health information, Consumer Health Data, or user communications for interest-based advertising or cross-context behavioral advertising. Additional information regarding our use of cookies and similar technologies is provided in Section 8.
You may opt out of receiving promotional or marketing communications at any time by following the unsubscribe instructions included in the communication, adjusting your account preferences where available, or contacting Company. Opting out of marketing communications will not affect transactional, account-related, security, or other legally required communications.
10. Consumer Health Data and Health-Related Browsing Information
Company does not ask Consumers to provide medical records, diagnoses, treatment information, symptoms, medications, appointment information, or other clinical information to browse the Directory. Nevertheless, under certain state consumer health privacy laws, Personal Information that identifies or may be linked to a person seeking health-related services may be treated as “Consumer Health Data.”
Where applicable, Company processes Consumer Health Data only as reasonably necessary to provide Site functionality requested by the Consumer, for other purposes described in Company’s separate Consumer Health Data Privacy Policy, or with consent where required by law. Company does not sell Consumer Health Data and does not use or disclose Consumer Health Data for targeted advertising.
Consumers should not submit health information through general contact, support, complaint, or privacy-request channels. Information provided directly to a therapist or other third party is governed by that recipient’s practices and is not processed by Company unless expressly stated.
11. Third-Party Websites, Therapists, and Other Parties
The Site may link to or integrate with independent therapist websites, scheduling tools, mapping tools, social media platforms, payment processors, analytics providers, advertising partners, and other third parties. Company does not control and is not responsible for those parties’ privacy, security, content, or legal compliance. A link or integration does not imply that Company endorses the third party. You should review the privacy notices of any third party before providing information.
12. Data Retention
Company retains Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide and secure the Site; maintain Listings and accounts; process transactions; comply with legal, tax, accounting, and contractual obligations; resolve disputes; enforce agreements; prevent fraud and abuse; and protect Company and others. Retention periods vary based on the nature of the information and the applicable purpose.
Listing Content may remain publicly available while a Listing is active. Following removal, Company may retain archival, backup, transaction, complaint, and compliance records as reasonably necessary. Search engines, archival services, and other third parties may continue to retain copies independently. Company may retain aggregated and de-identified information that does not reasonably identify a person, household, or device for lawful purposes.
13. Information Security
Company uses administrative, technical, and organizational safeguards designed to protect Personal Information against unauthorized access, acquisition, disclosure, alteration, loss, or destruction. The safeguards used depend on the nature of the information and include measures designed to protect account credentials, payment-related data, systems, and communications.
No website, network, transmission, or storage system can be guaranteed to be completely secure. Listing Providers are responsible for securing their devices, accounts, passwords, and linked third-party accounts and for promptly notifying Company of suspected unauthorized account activity. Consumers should not send sensitive medical, financial, or identity information to Company.
14. Your Privacy Rights and Choices
14.1 Account and Listing Information
Listing Providers may review and update certain account and Listing information through available account tools or by contacting Company. Requests to remove a Listing are governed by the Therapist Listing Agreement.
14.2 Marketing Communications
You may unsubscribe from promotional emails by using the unsubscribe link in the message or contacting Company. Listing Providers may continue to receive transactional, billing, renewal, security, account, and legal communications while an account or paid Listing remains active or as otherwise necessary.
14.3 State Privacy Rights
Depending on your state of residence and whether the applicable law applies to Company or the relevant processing, you may have the right to:
confirm whether Company processes your Personal Information;
access or obtain a copy of certain Personal Information;
correct inaccurate Personal Information;
request deletion of Personal Information, subject to exceptions;
obtain certain Personal Information in a portable format;
opt out of the sale or sharing of Personal Information, targeted advertising, or certain profiling;
limit certain uses or disclosures of sensitive Personal Information where applicable;
withdraw consent where processing is based on consent;
appeal a denial of a privacy request where applicable; and
not receive discriminatory treatment for exercising applicable privacy rights.
To exercise an applicable right, contact us at the email address set forth in Section 18, or use the applicable Cookie Preference Center or opt-out link. We may request information reasonably necessary to verify your identity and authority. An authorized agent may submit a request where permitted by law, subject to verification. Where required, we will provide instructions for appealing a decision.
Because Consumers generally browse without an account and do not provide identifying information, Company may be unable to identify or associate some browser or device data with a particular person. Requests may be limited where Company cannot reasonably verify or link the request to responsive information.
15. Children’s Privacy
The Site is intended for adults. Company does not knowingly collect Personal Information directly from children under thirteen (13) years of age. A parent or legal guardian may use the Directory to locate a therapist for a minor, but should not submit the child’s name, treatment details, or other identifying or detailed clinical information to Company.
16. Data Processing in the United States
The Site is intended for use in the United States. Company and its service providers may process Personal Information in the United States and other jurisdictions where they operate. Privacy and data-protection laws may differ among jurisdictions.
17. Changes to This Privacy Policy
Company may update this Privacy Policy from time to time to reflect changes in the Site, Company’s business practices, technology, or applicable law. Company will post the updated Privacy Policy on the Site and revise the “Last Updated” date above. Where required by applicable law, Company will provide additional notice or obtain consent before a material change becomes effective or before Company begins the applicable collection, use, or disclosure of Personal Information.
